Firmware update are completely handled only by internet service provider, since there are the one who providing signals to the modem.
Usually, we develops the software update and makes it available to service providers. The service providers qualify, test, and distribute the software update to devices on their network. It has limited control or visibility on distribution by the service providers.

Can you explain why you think the correct firmware is not installed? Have you done any troubleshooting with your ISP? Do you have appropriate signal levels?
