is it safe to use an opened box or returned Sb8200?

I am buying a Used, returned, opened box arris SB8200. 
wondering if I should concern of possibility that someone might implant a malware in it?  
I don’t think I can update firmware myself and am not sure if service provider will update it as it is my own modem.

Setting up the used SB8200 will not cause any issue because after performing hard reset on the modem that will configure your whole unit and since SB8200 is just a cable modem so its just a plug and play device. Updating firmware can be done only by your Internet service provider even for the device owned by the customer since the modem is activated by the ISP.
